The California Probate Code authorizes attorneys to serve the departed in a fiduciary capacity through the Business and Professions Code. Attorneys are by profession already fiduciaries, so they are exempted from the normal license requirements. The primary purpose of this role is to protect estates against fraud and to ensure that property is productive.
